This Return Policy outlines the cancellation, refund, and rescheduling terms for active break programs purchased from Drainingphscruba through drainingphscruba.world. Because our products are service-based workplace wellness programs rather than physical goods, this policy addresses program cancellations, session rescheduling, and refund eligibility for Pulse Starter, Momentum Growth, and Enterprise Flow packages.

Nature of Our Products

Drainingphscruba provides active break programs for companies including guided movement sessions, custom movement plans, facilitator delivery, participation tracking, and reporting services. These are intangible services delivered over an agreed schedule. Traditional product return procedures do not apply. Instead, this policy governs cancellation and refund requests for program purchases and unused sessions.

Cooling-Off Period

If you purchase an active break program as a consumer under the Consumer Guarantees Act 1993 and the contract was formed through unsolicited contact or away from our place of business, you may have a right to cancel within a statutory cooling-off period. For business-to-business purchases, which represent the majority of Drainingphscruba clients, the cooling-off period does not apply unless explicitly stated in your service agreement.

For all clients, if no sessions have been delivered and you cancel within seven calendar days of payment, we will provide a full refund minus any third-party processing fees incurred.

Cancellation Before Program Start

If you cancel your active break program before the first scheduled session:

Cancellation requests must be submitted in writing via our contact form or email to info@drainingphscruba.world with your company name, program tier, and original payment reference.

Cancellation After Program Start

Once active break sessions have commenced, refunds are calculated based on sessions remaining in your package:

Per-session values are calculated by dividing the total package price by the number of sessions included in the tier purchased.

Session Rescheduling

We understand that workplace schedules change. The following rescheduling terms apply to all active break program packages:

Program Upgrades

Clients may upgrade to a higher-tier active break package at any time during an active program. The remaining value of your current package will be credited toward the upgraded tier price. Upgrades are processed within five business days of written confirmation. Downgrades from a higher tier to a lower tier are treated as partial cancellations and subject to the early termination terms described above.

Service Quality Guarantee

Drainingphscruba is committed to delivering high-quality active break sessions. If a delivered session does not meet the standards described in your service agreement due to facilitator error, technical failure on our part during virtual delivery, or failure to provide agreed session materials, you may request a make-up session at no charge or a pro-rata refund for the affected session. Quality concerns must be reported within five business days of the session date with specific details about the issue encountered.

Our services are covered by the Consumer Guarantees Act 1993 where applicable, which provides that services must be carried out with reasonable care and skill, be fit for purpose, and be completed within a reasonable time.

Force Majeure

Neither party shall be liable for failure to deliver sessions due to events beyond reasonable control including natural disasters, pandemic-related restrictions, government mandates, facilitator illness, or infrastructure failures affecting virtual delivery platforms. In such events, Drainingphscruba will work with clients to reschedule affected sessions at the earliest mutually convenient time. If rescheduling is not possible within ninety days, a pro-rata refund will be issued for undelivered sessions.

Refund Processing

Approved refunds are processed within ten business days of written confirmation. Refunds are returned to the original payment method used for purchase. If the original payment method is unavailable, alternative arrangements will be made by mutual agreement. You will receive email confirmation when the refund has been initiated. Bank processing times may add three to five additional business days before funds appear in your account.

Disputes

If you are dissatisfied with a refund decision, please contact us to discuss the matter. We aim to resolve all disputes amicably within fifteen business days. If resolution cannot be reached, you may refer the matter to a New Zealand disputes resolution scheme or seek remedies available under the Consumer Guarantees Act 1993 or Fair Trading Act 1986 as applicable to your purchase.
